May 17, 2021 @ 4:30 p.m.

 

 

Selectman William I. Curless, Chair, opened the meeting at 4:30 p.m. with the Pledge of Allegiance.  Present at the meeting were William Curless, Chair; Dane Headley, Selectman; Walter Baker, Jr., Selectman; Carol Merullo, Town Clerk/Tax Collector; Lorri Himes, Town Bookkeeper; Bob DeFelice, North Sutton Improvement Society; Peter Stanley, Planning and Zoning Administrator; and Adam Hurst, Road Agent.

 

APPOINTMENTS:

The Board met with Carol Merullo and Lorri Himes to discuss Town Covid-19 Policies. As a result and effective immediately, the Board deemed face masks in town buildings will now be encouraged but not mandatory, and the Town Clerk/Tax Collector’s Office will now accept walk-ins. Appointments are preferred however, and will take precedent over walk-ins.

 

Bob DeFelice, North Sutton Improvement Society, met with the Board to request permission to relocate a sign on Map/Lot 07-947-371 along Wadleigh Hill Road  that had been approved by the Sutton ZBA for the Kezar Lake Protective Society on 4/21/21 via Case #‘s 2021-04 V and 2021-04 SE. After deliberating, and also getting some input on the matter by Peter Stanley, it was decided by the Board that ZBA approval for the sign was location specific. Furthermore, as the Board did not feel it had the authority to amend or overturn a ZBA decision, and even if it did, would not feel comfortable in doing so, the Board ruled that any relocation of the sign would require a new application and approval. The Board did note that any additional fees involved in this process would be waived.

 

Peter Stanley, Planning and Zoning Administrator, met with the Board to request its members sign a “Notice of Violation” letter dated 5/17/21 and addressed to Peacock Hill Road, LLC in Bedford, NH. The letter states that the company and its site on East Sutton Road (Map/Lot 01-173-097) are currently in violation of the “No Disturbance Buffer” or Condition of Approval #5 as stated in the Special Exception granted to the subject property on 4/21/21 via Case 2021-03 for a 7-Lot cluster subdivision. More specifically, a temporary power structure has been illegally erected within the buffer/front setback area of the site and if not removed within thirty days of the date of the letter, the Town will begin legal proceedings to compel its removal. In addition, any related damaged or removed vegetation must be replaced. The Board unanimously approved the letter and signed it.

 

At 5:12 p.m. Selectman Baker made a motion to enter into nonpublic session under RSA 91-A:3, II(b) The hiring of any person as a public employee.  Selectman Headley seconded the motion.  The Roll was called with Selectman Curless, Selectman Headley and Selectman Baker voting in the affirmative.  Public Session reconvened at 5:20.   Selectman Headley made a motion to seal the minutes as they pertained to personnel.  Selectman Baker seconded the motion.  The Board was polled with Selectman Curless, Selectman Headley and Selectman Baker voting in the affirmative.

 

 

 

At 5:21 p.m. Selectman Baker made a motion to enter into nonpublic session under RSA 91-A:3, II(c) Matters which discussed in public, would likely affect adversely the reputation of any person other than a member of this Board.  Selectman Headley seconded the motion.  The Roll was called with Selectman Curless, Selectman Headley and Selectman Baker voting in the affirmative.  Public Session reconvened at 5:32 p.m. Selectman Headley made a motion to seal the minutes as it was determined that divulgence of this information likely would affect adversely the reputation of any person other than a member of this board.  Selectman Baker seconded the motion.  The Board was polled with Selectman Curless, Selectman Headley and Selectman Baker voting in the affirmative.

 

The minutes from May 10, 2020 were amended and approved.  The Board reviewed and approved the following manifests:

                Vendor Manifest:  $11,529.10

Payroll Manifest:   $10,592.40

Payroll Manifest:   $  3,615.76

 

BUILDING PERMITS:

The Board reviewed and approved the following building permits:

Paul and Barbara Scarpino,  East Sutton Road, 01-146-098, for a raised garden bed

John and Kristen Haynes, Johnson Hill Road, 02-4333-477, for a greenhouse

Michael and Gayle Beaton, Nelson Hill S., 06-932-133, for a new home

 

YIELD TAXES:

The Board reviewed and approved the following yield taxes:

Paul Hodgdon, Map/Lot 07-200-550 in the amount of $445.88

Freeman Boyton, Jr., Map/Lot 09-822-416 in the amount of $141.28

 

OLD BUSINESS:

The Board signed an agreement between the Town and KV Partners for conceptual design services relative to further development of the Grist Mill Parking area.

 

Selectman Baker indicated that the revised OHRV Draft Ordinance was presented to and approved by the Sutton Conservation Committee. Elly Phillips, Town Administrator, will schedule a Public Hearing on the Ordinance.

 

NEW BUSINESS:

The Board recognized and accepted a resignation letter submitted by Sutton Police Corporal Duncan Domey, effective 5/12/21. On behalf of the Town, the Board thanked Duncan for his service and wished him well in his new position as “Chief” of Police in Wilmot.

 

The Board approved and Selectman Curless signed a Congressionally Directed Spending Item Request Form FY 2022 in hopes of obtaining funding assistance for the improvement of Shaker Road.

 

MEETING CONTINUANCE:

At 5:50 PM, Selectman Curless made a motion to continue the meeting until the next scheduled meeting of the Select Board on May 24, 2921 at 4:30 PM. Selectman Baker seconded the motion and the motion carried unanimously.

Select Board – Continued Meeting

May 24, 2021 @ 4:30 p.m.

 

The meeting was reconvened on May 24, 2021 at 4:30 p.m. by William I. Curless, Chair.  Present at the meeting were William Curless, Chair; Dane Headley, Selectman; Walter Baker, Jr., Selectman; and Elly Phillips, Town Administrator.

 

Selectman Curless led those present in the Pledge of Allegiance.

 

The Board reviewed and approved the following manifests:

Vendor Manifest:   $303,705.32

Payroll Manifest:    $  10,572.99

 

BUILDING PERMITS:

A building permit was approved for Daniel Knox, Map/Lot 10-066-102, Rowell Hill, for a garage.

 

OLD BUSINESS:

Peter Stanley, Zoning Administrator provided a report that Peacock Hill, 01-173-097, East Sutton Road, was coming into compliance with zoning violations.

 

The Board instructed Phillips to schedule a public hearing regarding a proposed OHRV Ordinance to allow access to an owner’s property via a Class VI Road with written permission from the Select Board.

 

The Board noted a complaint from Jeff Evans regarding an approved driveway access on Pound Road.

 

The Board discussed the process for wetlands inspections for building permits.  Several suggestions were discussed including using the wetlands overlay as a benchmark.  Phillips will follow up with Counsel.

 

Phillips reported that roof repairs will be done on the library and Town Hall beginning May 26, 2021.  The library roof repairs will be done first.  It is anticipated that all work will be completed by next week.  The Board discussed future staffing needs and noted that the Town should have a position to oversee facilities management.  It was suggested that this position could be combined with the building inspector/code enforcement officer.   Selectman Curless suggested that the Highway Department needed an administrative assistant, and perhaps, it could also be a combined position with existing personnel.

 

NEW BUSINESS:

Jack Noon has requested permission from the Select Board to open Old Store Museum.  Permission was granted.  It was noted that the Historical Society has received a prestigious grant and will be removing the steeple from the Meeting House for repairs in the coming weeks.  In addition, there is a dead tree that needs to be removed near the Soldier’s Monument.  Boundary’s will be checked to ensure the tree is on Town property.  Selectman Curless suggested that flagpole repairs could be done at that time.   Phillips will follow up.

 

The Board received an invitation from Marilyn Thompson, American Legion Chief Chaplain and Pete Thompson, American Legion Service Officer,  to participate in the Memorial Day Service which is being held on May 31, 2021 beginning at 11:00 a.m.  Jack Noon will be the guest speaker.

 

The Board agreed to execute the 1st Issue Tax Warrant as soon as it becomes available.  It was noted that the assessors were still updating pickups.  If it is not available this week, the Board will execute the Warrant at their regularly scheduled meeting on June 1, 2021.

 

REVIEW OF CORRESPONDENCE:

 

SELECTMEN’S COMMENTS:

Selectman Baker advised that he coordinate a meeting with Jack Noon to assess repairs required for the Old Store Museum.

 

Selectman Curless received a question regarding the Grist Mill Bridge relocation and whether or not their will be an onsite contractors meeting and whether a concrete structure fabrication was required.  Selectman Curless advised that  there will not be a contractor’s onsite meeting, a concrete structure was not required for storage of the bridge.  Selectman Curless also verified the location of the bridge and the Highway Department and discussed equipment that would be required for the relocation.  The Board will open the RFP’s at 5:00 p.m.  at their meeting scheduled for June 1, 2021.

 

There being no further business, the meeting was adjourned at 5:14 p.m.
